ACLU: Drivers licenses are a right

Yet another in a long line of moonbattery from the ACLU:

Many of the cases already have been resolved, but the ACLU of Indiana filed suit Friday in Marion Superior Court and plans to seek an injunction to make sure no licenses are revoked without hearings, the group’s legal director said.

“What the BMV is doing is taking legally an entitlement from thousands of people,” the ACLU’s Ken Falk said. “You’re entitled to have a driver’s license and the state can’t come and take it away from you.

I don’t know how to break it to you rocket scientists at the ACLU, but the state can “come and take it away from you”!  If you’re convicted of a DUI, you can lose your license.  If you try to buy alcohol or cigarettes and you’re underage, you can lose your license.  If you go to get it renewed and you fail the driving exam, you can lose your license. If you obtained a drivers license under false pretense, you can lose your license.

Morons.

  1. State laws re: drivers licenses vary greatly; many allow the state to pre-emptively revoke or suspend while giving the licensee an opportunity to challenge that ruling at a later date. From the article, it sounds like most people have already taken care of the bureaucratic SNAFU that got them suspended in the first place. The rest? Hmmm, who could possibly (a) have a license, (b) have an SSN, but (c) not want to come in to verify whether or not it’s valid?

  2. You’re absolutely right in that a driver’s license is a privilege and not an entitlement. However, I would have to agree that the State should not be able to revoke said privilege without a hearing. The State should have to prove such action is necessary, as it does in DUI cases for example.

  3. Actually, in Texas you can lose your license for many things. A DUI conviction is not required.

    -Failure to submit to a breathalyzer.
    -Purchasing alcohol or tobacco for a minor (or as a minor).
    -Medical disabilities.
    -Mental disabilities.
    -Acohol related offenses (non-driving) as a minor.
    -Drug convictions.
    -Unpaid fines.
    -Failure to maintain financial responsibility (no insurance).
    -Habitual trafic violations.
    -Violation of driver’s license restrictions.

    The list goes on and on and contains may non-driving related reasons for suspension or restriction of you driver’s license. It is in every way a privellege and in many case our state requires no hearing or conviction to change the status of your license. As an example, if you refuse a field sobriety test or refuse to submit to a breath alyzer test, it is an automatic six months suspension of your license. No hearing, just instant suspension.

    According to Texas law, anything that you require a State issued license to do means that you have entered into an agreement with the State that they will allow you to perform such function as long as you agree to the terms and conditions of the license. You violate those tems and conditions and the State hase every right to instantly revoke or suspend said license.

  5. THEN IF THEY DO GRANT DRIVERS LICENS TO ILLEGAL ALIENS BECUASE OF A STUPID LAWSUIT AND A EQUIALY STUPID LIBERALA CTIVISTS JUDGE THEN CAN THE VICTIMS FAMILY SUE THE ACLU AND THAT JUDGE FOR EVERYTHING THEIR WORTH?
