Justice Department political appointees overruled career lawyers and ended a civil complaint accusing three members of the New Black Panther Party for Self-Defense of wielding a nightstick and intimidating voters at a Philadelphia polling place last Election Day, according to documents and interviews.
The incident – which gained national attention when it was captured on videotape and distributed on YouTube – had prompted the government to sue the men, saying they violated the 1965 Voting Rights Act by scaring would-be voters with the weapon, racial slurs and military-style uniforms.
Career lawyers pursued the case for months, including obtaining an affidavit from a prominent 1960s civil rights activist who witnessed the confrontation and described it as “the most blatant form of voter intimidation” that he had seen, even during the voting rights crisis in Mississippi a half-century ago.
The career Justice lawyers were on the verge of securing sanctions against the men earlier this month when their superiors ordered them to reverse course, according to interviews and documents. The court had already entered a default judgment against the men on April 20.
A Justice Department spokesman on Thursday confirmed that the agency had dropped the case, dismissing two of the men from the lawsuit with no penalty and winning an order against the third man that simply prohibits him from bringing a weapon to a polling place in future elections. (Are we to assume that it was legal for him to bring a weapon to a polling place BEFORE this order? – Ed.)
The complaint said the three men engaged in “coercion, threats and intimidation, … racial threats and insults, … menacing and intimidating gestures, … and movements directed at individuals who were present to vote.” It said that unless prohibited by court sanctions, they would “continued to violate … the Voting Rights Act by continuing to direct intimidation, threats and coercion at voters and potential voters, by again deploying uniformed and armed members at the entrance to polling locations in future elections, both in Philadelphia and throughout the country.”
To support its evidence, the government had secured an affidavit from Bartle Bull, a longtime civil rights activist and former aide to Sen. Robert F. Kennedy’s 1968 presidential campaign. Mr. Bull said in a sworn statement dated April 7 that he was serving in November as a credentialed poll watcher in Philadelphia when he saw the three uniformed Panthers confront and intimidate voters with a nightstick.
Inexplicably, the government did not enter the affidavit in the court case, according to the files. (I’m sure it was just a mere bureaucratic snafu, right? – Ed.)
“In my opinion, the men created an intimidating presence at the entrance to a poll,” he declared. “In all my experience in politics, in civil rights litigation and in my efforts in the 1960s to secure the right to vote in Mississippi … I have never encountered or heard of another instance in the United States where armed and uniformed men blocked the entrance to a polling location.”
Mr. Bull said the “clear purpose” of what the Panthers were doing was to “intimidate voters with whom they did not agree.” He also said he overheard one of the men tell a white poll watcher: “You are about to be ruled by the black man, cracker.” (Word, dawg. – Ed.) …

“I’ve seen with my own eyes how many brothers of mine serve God as married men and with the blessing of having their own families,” said Father Alberto Cutie, whose removal from his Miami Beach parish prompted public debate about the Catholic Church’s celibacy requirement for priests. …
Let me get a couple of things out of the way here.
First of all, there is nothing in the Bible that says God expects clergy to remain unmarried. Why the Catholic church deems otherwise is beyond me. However, it’s no secret that this is indeed the Church’s position. If you think you may want to serve God AND be a husband and a father, then you do not become a Catholic priest. “Yes, but what if you change your mind when you get older?” Then don’t make a vow before God that says you commit your life to remain celibate! We have enough people in this country who profess to be Christian who routinely, without batting an eyelash, break vows before God. We sure as heck don’t need a man of the cloth doing that! “Hey, sorry about breaking that promise to you, God! Them’s the breaks, though, right? Maybe I’ll do better next time…maybe.”
Secondly, why would the Episcopalian church accept a minister who clearly has no regard for vows made before God? Then again, this Church has already demonstrated that it doesn’t always hold God’s word in the highest regard, as evidenced by its ordaining of an openly and practicing homosexual minister.
We all sin. We all stumble. Heck, I do every day, and I ask God’s forgiveness when I do. But when you stumble and sin, you repent…which means you turn from your sin. This “minister” is not turning from his sin of breaking his vow before God…he’s running full speed with zeal into the arms of the sin. May God have mercy on him, as may He have mercy on us all.
Remember the reaction from those in attendance when the allegedly funny Wanda Sykes called Rush Limbaugh the 20th hijacker who she desired to see die of kidney failure? Well, for starters, we know that she thinks it is the role of the appeals courts to make policy:

We also know that she is a racist and a sexist:

Anyone care to guess what the reaction from the left and the MSM (pardon the redundancy) would have been if a white dude had made an identical statement that lauded the advantages that while maledom would bring to the court?
We know that Uhhh-bama told us during the election that SCOTUS justices don’t need to know the Constitution, so long as they possess a trait more important than that: empathy. Do you people now see why I refer to liberalism as a “feeling, not thinking” ideology? Any man who thinks that a SCOTUS justice who “empathizes” better than she understands the Constitution that she’s been given lifetime tenure to interpret is clearly devoid of any thinking skills. Therefore, it should come as no surprise that he picks a nominee who is equally dismissive of prerequisites of constitutional knowledge.
One other thing we know: the American Idol that the lost sheeple elected last year will see his nominee approved, regardless of what kind of ideologue she is.

Alas, Leon Panetta (THAT Leon Panetta?) throws her under the bus on that one, too. So what does the White House have to say on the matter? “Present.“
Dick Cheney says that Obama is a threat to national security. Gore slams Cheney for the comments, saying that he at least waited two years before accusing Bush of “betraying the country” and “playing on our fears.” There’s a problem with the Goreacle’s comments, though: he’s lying through his teeth. “Two years” apparently means “a little less than one year, several times.” His lies were easy to verify via a cursory search on the Internet, which led Adam White to quip: “I’ve turned Al Gore’s own creation against him.”
Bubba recently said that Dick Cheney should avoid criticizing Oprompter, because “I do hope he gets some target practice before he goes out again.” Someone please tell me that a man who had a little “shooting” trouble of his own around a certain blue dress is not critiquing anyone’s aim!

An EPA finding last month that greenhouse gases are a danger to public health rests on dubious assumptions and could have negative economic impacts, a memo from the Office of Management and Budget (OMB) warned.
The memo has no listed author but is marked “Deliberative–Attorney Client Privilege.” A spokesman for OMB told Dow Jones Newswires that the brief is a “conglomeration of counsel we’ve received from various agencies” about the EPA finding, the conclusions of which would trigger regulation of greenhouse gases under the Clean Air Act.
The author(s) of the memo suggest the EPA did not thoroughly examine the relationship between greenhouse gases and human health.
“In the absence of a strong statement of the standards being applied in this decision, there is concern that EPA is making a finding based on…’harm’ from substances that have no demonstrated direct health effects,” the memo says, adding that the “scientific data that purports to conclusively establish” that link was from outside EPA.
Finally, in language sure to anger climate change activists, the memo questions whether climate change might bring benefits that would mitigate the costs.
“To the extent that climate change alters out environment, it will create incentives for innovation and adaption that mitigate the damages,” the memo reads. “The [EPA finding] should note this possibility[.] … It might be reasonable to conclude that Alaska will benefit from warmer winters for both health and economic reasons,” the authors note.
You mean that IF these so-called “greenhouse gases” exist, they might actually be…dare I repeat it?…beneficial!
I’m sure that you have all noticed the cost of gas going up about a quarter in the last couple of weeks. Ever since gas climbed over $4 last year, I’ve been following “petropolitics” to keep my fingers on the pulse of the state of gasoline and oil products in the world. I knew that speculators were to blame for last year’s detached-from-reality spike in prices, and I know that they’re going back to the buffet for seconds right now.
For a primer on my take, refer to last year’s post called “Is this REALLY capitalism?” You’ll get the full version on how speculators artificially inflate prices that have no basis in supply-and-demand economics, all while contributing jack squat to the oil-to-consumer process. Here’s what is going on today:
…But Jim Smith, president and CEO of the Florida Petroleum Marketers and Convenience Store Association Inc., said a global drop in demand has created a glut of crude and refined oil product reserves, precluding normal price increases from the explanation.
“Oil speculators have entered back into the market,” he said. “It’s the only excuse.”
Smith said customers have contacted him expressing worry or anger about the increases, but calls from concerned member retailers have outnumbered them.
“They’re upset,” he said. “It has a signification impact on their business operations.”
That’s because most retailers price close to the wholesale prices on gasoline, depending on profits from other items they sell in convenience stores, to stay competitive, he said.
“We’re price takers, not price makers. We have to buy from oil companies,” he said.
But Smith said he doesn’t blame the oil companies for the increase. He thinks the rise in crude oil prices — from $49.92 a barrel April 28 to $58.50 Monday — signals that speculators are affecting pricing.
“There is not a single, solitary reason to justify increases in crude oil prices,” he said.
The average price for a gallon of regular unleaded gas in Jacksonville hadn’t gone above $2.11 a gallon since late last year, according to jacksonvillegasprices .com.
Smith said he’s concerned that the price of gas can go even higher — despite high supply, low demand and an economic recession — because of a loophole Congress left open.
Sen. Bill Nelson, D-Fla., hopes to close that loophole, which would allow certain energy and metal futures traders to manipulate prices via the Internet, through a bill he introduced in January, Nelson spokesman Dan McLaughlin said.
Nelson and Sen. Maria Cantwell, D-Wash, as well as J. Stephen Simon, executive vice president of Exxon-Mobil, have said speculators were largely, if not entirely, responsible for gasoline’s spike above $4 a gallon last summer.
Right now, unemployment is sky high. The Dow is in the tank. Our oil storage facilities are busting at the seams with supply. Demand is lower than it has been in nearly a generation. People are pinching their pennies. Therefore, there is absolutely no single reason whatsoever for oil prices to be rising!
This isn’t capitalism, my friends. It’s not Big Oil, nor the treehuggers or the global warming nuts, nor China and India (two countries that speculators and their apologists tried to blame last year) causing this irrational jump in prices. This is extortion by investment firms that are starving for profit, even ill-gotten ones. As much as I hate to say it, I fully support Sens. Nelson and Cantwell in their efforts to rein in the big money speculators who are trying once again to drive oil prices sky high while they line their pockets with money that was earned on deception.
President Oprompter was schmoozing with his constituents this weekend at the White House Correspondents’ Association dinner. How’s about this:

A rare nugget of honesty from a demonstrable pathological liar is refreshing to see, no?
Via the Washington comPost, Wanda Sykes indicts the press, albeit unintentionally:
“It’s funny to me that [photographers] have never caught you smoking,” Sykes told the president, “but they always catch you with your shirt off. I know you’re into this transparency thing, but I don’t need to see your nipples.”
Then, via the UK’s Telegraph, she indicts herself as a classless, crass loudmouth:
This is what she said: ”Rush Limbaugh said he hopes this administration fails, so you’re saying, ‘I hope America fails’, you’re, like, ‘I dont care about people losing their homes, their jobs, our soldiers in Iraq’. He just wants the country to fail. To me, that’s treason.
“He’s not saying anything differently than what Osama bin Laden is saying. You know, you might want to look into this, sir, because I think Rush Limbaugh was the 20th hijacker. But he was just so strung out on OxyContin he missed his flight.”
She then concluded: ”Rush Limbaugh, I hope the country fails, I hope his kidneys fail, how about that? He needs a good waterboarding, that’s what he needs.” Obama seemed to think this bit was pretty hilarious, grinning and chuckling and turning to share the “joke” with the person sitting on his right.
There’s not much room for differing interpretations of what Sykes said. She called Limbaugh a terrorist and a traitor, suggested that he be tortured and wished him dead.
What was his crime? Hoping that Obama’s policies – which he views as socialist – will fail.
That’s way, way beyond reasoned debate or comedy and Obama’s reaction to it was astonishing. …
And Obama laughing when someone wishes Limbaugh dead? Hard to take from the man who promised a new era of civility and elevated debate in Washington.
Interesting that Sykes’ shameful comment about Rush wasn’t covered by the Washington comPost in that first link. But no, no liberal media bias!
Compare and contrast, though, jokes about Pelosi dying:
CBS Sports golf analyst David Feherty apologized Sunday to House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid for a morbid joke that went bad in a Dallas magazine.
Feherty, one of the most popular golf analysts for his sharp wit and self-deprecating humor, was among five Dallas residents who wrote for “D Magazine” on former President George W. Bush moving to Dallas.
“From my own experience visiting the troops in the Middle East, I can tell you this though,” Feherty wrote toward the end of his column.
“Despite how the conflict has been portrayed by our glorious media, if you gave any U.S. soldier a gun with two bullets in it, and he found himself in an elevator with Nancy Pelosi, Harry Reid and Osama bin Laden, there’s a good chance that Nancy Pelosi would get shot twice, and Harry Reid and bin Laden would be strangled to death.”
Feherty, a former Ryder Cup player who grew up in Northern Ireland, has gone to Iraq over Thanksgiving the past two years to visit with U.S. troops, and he created a foundation to help wounded soldiers.
“This passage was a metaphor meant to describe how American troops felt about our 43rd president,” Feherty said in a statement. “In retrospect, it was inappropriate and unacceptable, and has clearly insulted Speaker Pelosi and Senator Reid, and for that, I apologize. As for our troops, they know I will continue to do as much as I can for them both at home and abroad.”
For the record, it’s not funny to wish death on anyone. It is sad, though, that the MSM gets its dinosaur boxers in a bunch when someone jokes about Pelosi dying, but hoots it up when someone jokes about Rush dying. But again, nope…no liberal media bias!

Intelligence officials released documents this evening saying that House Speaker Nancy Pelosi (D-Calif.) was briefed in September 2002 about the use of harsh interrogation tactics against al-Qaeda prisoners, seemingly contradicting her repeated statements over the past 18 months that she was never told that these techniques were actually being used.
In a 10-page memo outlining an almost seven-year history of classified briefings, intelligence officials said that Pelosi and then-Rep. Porter Goss (R-Fla.) were the first two members of Congress ever briefed on the interrogation tactics. Then the ranking member and chairman of the House Intelligence Committee, respectively, Pelosi and Goss were briefed Sept. 4, 2002, one week before the first anniversary of the 9/11 terrorist attacks. …

President Obama is distancing himself from the National Day of Prayer by nixing a formal early morning service and not attending a large Catholic prayer breakfast the next morning.
All Mr. Obama will do for the National Day of Prayer, which is Thursday, is sign a proclamation honoring the day, which originated in 1952 when Congress set aside the first Thursday in May for the observance.
For the past eight years, President George W. Bush invited selected Christian and Jewish leaders to the White House East Room, where he typically would give a short speech and several leaders offered prayers.
Obama White House press secretary Robert Gibbs said Tuesday that the president is simply reverting back to pre-Bush administration practice.
“Prayer is something the president does every day,” he said. “We’re doing a proclamation, which I know that many administrations in the past have done.”
Pressed by reporters as to the lack of a formal ceremony, Mr. Gibbs said the proclamation was Mr. Obama’s choice.
“That’s the way the president will publicly observe National Prayer Day – privately, he’ll pray as he does every day,” Mr. Gibbs said. …

Yet another memo has emerged from her agency that describes a different breed of “extremists”: People who oppose giving drivers licenses, in-state tuition, medical benefits, or public schooling to criminal aliens. That pretty much paints the vast majority of Americans as “extremists”, no? Conspicuous by its absence from the list of “extremists”, however, is Muslim extremists. “Jewish extremists” is on the list, though, although for the life of me, I can’t recall an act of domestic terrorism perpetrated by a Jewish extremist.
